Terms of Service

1. Who you're contracting with

GLW Studio (the "Service") is operated by Winslow Pacific ("we," "us," or "our"). By creating an account, purchasing a plan, or otherwise using the Service, you ("you" or the "Customer") agree to these Terms of Service.

2. Acceptance

Your continued use of the Service constitutes acceptance of these terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business. If you are using the Service as an individual, you represent that you are of legal age to enter into a binding contract in your jurisdiction.

3. The Service

GLW Studio is a managed website service for independent practitioners. We design, build, host, and maintain a website on your behalf, and provide related features such as appointment booking integration, intake forms, social-feed embeds, and optional online payments.

4. Acceptable use

You must not misuse the Service. Specifically, you agree not to:

• Use the Service for any unlawful purpose, fraud, or to send spam.
• Infringe any intellectual property, privacy, or publicity rights of others.
• Upload malware or attempt to probe, scan, or compromise the security of the Service.
• Scrape, reverse engineer, or attempt to extract source code from the Service.
• Resell, sublicense, or redistribute the Service to third parties.

5. Your account and content

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and keep it updated. You retain ownership of the content you provide (photos, copy, branding); you grant us a limited license to host and process that content solely to provide the Service.

6. Intellectual property

We retain all rights, title, and interest in the Service, including its software, templates, design system, documentation, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service for the duration of your active subscription, within the scope of your selected plan.

7. Payments and subscriptions

Billing for the GLW Studio managed website service is handled through our Winslow Intake platform, which is operated by the same company (Winslow Pacific). When you sign up for the Service, your subscription, payment method, invoices, and cancellation are all managed from your Winslow Intake account.

Subscriptions renew automatically at the interval shown at checkout (typically monthly) until cancelled. You can cancel at any time from your Winslow Intake dashboard or by contacting us; cancellation takes effect at the end of the current billing period.

8. Refunds

Refunds are governed by our Refund Policy.

9. Service level

We work hard to keep the Service available and performant, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension and termination

We may suspend or terminate your access to the Service for: material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we will provide a reasonable window to export your content where feasible.

11. Liability

To the fullest extent permitted by law, our aggregate liability under these terms is capped at the fees you paid us in the twelve (12) months prior to the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

12. Indemnity

You agree to indemnify and hold us harmless from claims arising out of your content, your unlawful use of the Service, or your breach of these terms.

13. Changes

We may update these terms from time to time. Material changes will be communicated via email or a notice in the Service. Continued use after changes take effect constitutes acceptance.

14. Governing law

These terms are governed by the laws of the jurisdiction in which Winslow Pacific is established, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction.
